Code 50r when absent in the evidence.

Hi,

Code 50r from TFL at GROSVENOR PLACE SOUTHEAST BOUND JW HALKIN STREET.

Signage absent in the evidence photos provided. Road marking ahead only. No signage nor road marking to state no entry on the road on the right side.

Appealed as follows:

I am appealing this PCN on the grounds that the alleged contravention did not occur. The PCN states the vehicle performed a 'prohibited turn (no right turn- code: 50r)'. However, the photographic evidence provided by the authority only demonstrates an 'AHEAD ONLY' road restriction (code: 32) and completely fails to establish the presence of a 'No Right Turn' sign. Because the authority has applied a contravention code and description that is entirely unsupported by their own photographic evidence, the PCN is invalid and must be cancelled.

-Rejected.

What is the percentage of winning at tribunal if appealed on the ground of unsufficient evidence / contravention did not occure as under the TSRGD, road markings alone are advisory and legally insufficient to enforce a Code 50 contravention?

Thank you for your time.

It would be helpful if you can post the paperwork for us to see.
Bus driving since 1973. My advice, if you have a PSV licence, destroy it when you get to 65 or you'll be forever in demand.

AFAIK the "Ahead Only" road marking is in fact mandatory.
