Adding to thread - brothers appeal was rejected. He didn’t have signed letter from occupier of the property at time of initial appeal. Will take it further to the tribunal.

Also another point to add
If there is another vehicle that appealed and then paid after it was rejected, is there a way to make the council pay back?
Or at the point of payment - is it too late?

@Fightback

As others have explained, forum rule is one case, one thread. It sounds as if your brother may have a good case, so please start (or let him start) a new thread for his PCN with the usual info - both sides unredacted PCN, copy of his challenge, copy of rejection, any other paperwork, council images and GSV link. By all means include a link to this thread.

I can then tidy up this thread by removing redundant posts.

Turning to your own PCN (the subject of this thread). Did you post yr challenge as per your post #14 above? Have you received a reply?

Apologies - I have started a new thread and just about to submit my appeal!

Just wanted to add another PCN was received this morning (different car but exact same location & contravention code).

Didn’t want to start a new thread as it is the exact same - will go ahead and use the same appeal.

It is clear that someone on the road is complaining.

Then the sooner the letter of authority is submitted the better so that its authenticity can be examined by the council.

Has been submitted in the last appeal.
Neighbour also came out today and informed warden that she didn’t report it so why are they giving a ticket.

He stated that it was too late as already had been issued, challenge it and it will be overturned.

Just as an update - have received a response from authorities who have requested further information:

"Although you have provided us with some information, we need more information to be able to cancel
your PCN. Details of the information we need are below.
We will reconsider your case if you send us a copy of the residents driving licence or council tax
statement. Once the documents have been sent for checks, we will update you should this PCN be
cancelled."

As I posted earlier, any permission from the occupier would be tested at least to the extent of determining whether the person is the occupier. Presentation of either a photocard licence or council tax would apparently be sufficient.

Disagree that it's reasonable for me to ask a neighbour for a copy of their private documents. Will challenge why a letter is not sufficient (is it dated / has an address and physically signed), they should be able to verify against their internal records.

I didn't say it was reasonable or not,  I simply recited what they'd said and expressed the view that I wasn't surprised.

If the owner is claiming an exemption, as here, then the legal burden shifts to them to prove your entitlement.

You could take your line with the council and see what happens, likelihood is you would be putting this to the test in front of the adjudicator with, as I understand it, and increasing number of full penalties in play.

At present you do not have a refusal, instead you have a request for information for the purpose of testing your claim.
