Author Topic: Clean Air Zone PCN Bristol City Council - Code 17J - A370 Brunel Way (CAZ0048)  (Read 815 times)

I have received a PCN for driving in the CAZ in Bristol without paying the CAZ. Below are links to pages of the PCN. I have read through posts on here and elsewhere and it seems to me there is only one currently viable ground of appeal, based on the excessive charge of the premium rate phone number as an option to pay. I am looking for advice on my representations and would be pleased to be told there are other grounds I could include. The deadline to submit the representations is tomorrow, Friday 15 September 2023. I regret to say I have been sticking my head in the sand about it.

That's not a bad start. They tried resisting the argument in this case but they gave up, however I have all the submissions / case law ready to go if they actually decide to fight the next case.
I practice law in the Traffic Penalty Tribunal, London Tribunals, the First-tier tribunal for Scotland, and the Traffic Penalty Tribunal for Northern Ireland, but I am not a solicitor or a barrister. Notwithstanding this, I voluntarily apply the cab rank rule. I am a member of the Society of Professional McKenzie Friends, my membership number is FM193 and I abide by the SPMF service standards.

There's another flaw on the PCN. Nowhere does it explicitly state the 28 day payment period.

The 28 day payment period is referred to in the yellow section at the bottom of p1 and top of p2
