Hi all,
I have received my PCN this afternoon after parking in a suspended bat which required 5 metres free (1 space) as stated by the notice in the attachment. When I arrived on the street the bay was completely empty  (5.20am, I can prove it with my motorcycle tracker device), therefore I parked on the edge so that the 5 metres compliance was met. When coming back to my vehicle I found mine and 3 more motorcycles were issued with a pcn while two more on the other side of the bay didn't receive anything. The fun fact is that they did the same suspension two weeks before and I parked the same way as today, without receiving a fine. On what grounds I can appeal? Thanks

The bay is 10.2 metres long according to GSV, and not subdivided into individual parking bays, so the sign is a complete mess, frankly. They seem to assume motorcyclists go around with a tape measure in their pocket !

Can you indicate on the latest GSV view exactly where you were parked, please.

I parked my bike between the O and the N of "Only" so nearby the right edge of the bay. I did this exact thing the last time they suspended the parking in the same bay and didn't get fined that time. And it was two weeks ago.

So again using GSV distance measurement, you were about 2.7 metres from the north end of the bay, and also directly opposite the door of the Japan Centre. However the bay is not subdivided so if they want to suspend parking in part of it they have to be precise and for me, the suspension sign is ridiculous on its own, they should have place something to physically mark the boundaries of the suspended area.

So I suggest you submit an informal challenge on the following lines: -

Dear Sirs
Re PCN <PCN Number> dated <dd/mm/yyyy) served at <time> at <location>

I deny liability for the above PCN penalty on the grounds that the contravention did not occur. I read the suspension sign, but it does not give accurate information on which part of the bay is suspended. The sign states that 5 metres, (one space) is suspended. However, the bay is just under 12 metres long, with no subdivisions therefore it is impossible to work out which part is suspended in the absence of any physical measure like traffic cones.

In view of the defective information on the suspension sign, I request that the PCN be cancelled.

Don't expect them to roll over and cancel, because all they are interested in is your money. You have to be prepared to take them to London Tribunals, where, IMHO, you would have a strong case However, see what the others say before submitting reps, but don't miss the deadline for submitting them.

Thank you very much for your reply and help, I will wait few more days before submitting my appeal. Would that make my appeal stronger stating that their evidence is also misleading? As they pictured the "motorcycles only" sign, the suspension sign and then just a picture of my bike parked on the bay, without any kind of indication on where it was parked (in terms of space avaliable left). Thanks
