Camden, Parking in Suspended Bay, Priory Road
« on: »
Hello,
I have received a PCN this morning in Camden council on Priory Road for parking in a space that was covered by a 24 hour parking suspension for tree cutting. It was in the CA-R parking zone for which I have a residents permit.

Last night I went out to pick up my wife who had met friends and came back and parked in the bay at around 11:45 PM, at 8am this morning (17th October) I went out to find a PCN which was issued at 7.20 this morning. Looking at the images in the PCN the parking suspension is clearly marked. I feel like it is unlikely (tho admittedly possible) that I missed this last night, and was hoping to challenge the PCN based on when the Parking Suspension sign was erected. Can I request that the council prove that adequate notice was place on the suspension and challenge on that basis? PCN and Image from the fine included below. Thank you very much in advance for your help.

It's unlikely the bay was suspended this morning unless this is an emergency. Is any tree works going on?

Camden is one of the few that has detailed info on suspensions including a map of current and upcoming  ones:

https://opendata.camden.gov.uk/Transport/Camden-Parking-Suspensions-Map/2syn-p56x

presumably from this dataset:

and you can also sign up to email alert for a search term (eg your road):

Hi, thank you very much for the really helpful reply. Doesn't sound promising! There are tree works going on but they don't strike me as an emergency. So is it likely that its not worth challenging this PCN?

I can't see from the data that there is a field showing when a suspension sign went up or was registered on the database and in any case it's worth a polite ask as a resident coming back late.

They do log cars in bays when signs go up but here we are talking about 15 mins til the suspension went live if you parked at 15 mins to midnight!

Did you move the car?

Yes I have moved the car to another bay in my parking zone that isn't covered by a parking suspension. You are correct that I only came into the spot at a quarter to midnight, 15 mins before the suspension started. I guess there is not harm in trying a appeal. Would you be able to provide your feedback to the below appeal (with thanks to ChatGPT for the text  :) ). Many thanks again!

Dear Sir/Madam,

I am writing to formally challenge the Penalty Charge Notice (PCN) [PCN Number] issued to my vehicle [Vehicle Registration Number] on [Date of Issue]. The PCN was issued for parking in a suspended bay on [Street Name], which I was unaware of at the time.

On the evening of [Date], I returned to the parking space late at night and did not see any suspension notice. I believe that the suspension notice was either not clearly visible or not placed in a timely manner. As a result, I was unaware that the bay was suspended and parked my vehicle there in good faith.

I kindly request that you provide evidence that the suspension notice was placed in accordance with the regulations and was clearly visible at the time I parked my vehicle. This evidence should include the date and time the notice was erected and photographs showing its placement and visibility.

Given the circumstances, I respectfully ask that you consider cancelling the PCN. I have always adhered to parking regulations and would not have parked in a suspended bay had I been aware of the suspension.

Thank you for your understanding and prompt attention to this matter. I look forward to your response.
