Author Topic: Greenwich PCN - Code 01 parked in a restricted street during prescribed hours  (Read 927 times)

Hi All, have got the good old 01 PCN. The location was the side road Tunnel Avenue just next to the O2 arena. A nutorious spot for parking, but this one is different. the road has recently been re-structured, 2 roads have closed off due to construction and I could see no signs whatsoever.

The catch: I was in north greenwich (21:05pm), and my 6 year old daughter needed the toilet, and I knew the station has a toilet.. i also knew the closest parking spot is somewhere here. i then got confused with the new road layout, but time was running out for my daughter so just parked there. as soon as i come back, i see the ticket inspectors process the ticket and get into thier car which was ALSO parked on the road. a red citreon WR73 HKC, and whats crazy is that down the street, 3 cars were parked and they drove past them without issuing anything.

ticket was issued 21:20

anyway i can get rid of this? probably a popular topic considering this road.

You can see it's clearly a stopping area, not part of the road basically. but technically, it probably is..

Well you parked on double yellow lines and don't appear to have an exemption - a toilet break isn't one unless it's a medical emergency.

Greenwich don't contest a lot of appeals at the tribunal but it would be a gamble.

The "layby" here is part of the carriageway as indicated by the double-yellow lines. The exemptions of (1) loading and (2) boarding/alighting passengers apply. As you no doubt know, DYLs apply 24x7 and need no signs.

Yes i am the registered keeper and all.

Fine. So you would likely get two bites at the cherry with the discount being re-offered.

But, as others have posted prima facie you were parked on 24/7 waiting restriction without good reason.

So, what issues are at large?

Is there actually a 24/7 waiting restriction in a traffic order? You could ask for the traffic order because this is the basis of the authority's case.

As said previously, would Greenwich actually resist any appeal at the tribunal and/or commit a serious procedural impropriety during the formal process?
