Bromley Road - Contravention 46
« on: »
Hi there, please can I get assistance with this alleged contravention.  I had parked for less than 5 mins to pick up something from the Tesco, I quickly looked at the signage and thought it was safe to park.

The gsv is: https://maps.app.goo.gl/MyFq79M13tHvaRMN8

Sign says 'No Stopping 7am-7pm
'Except' [up to] 30 minutes Parking 10am-7pm.

What made you think it was safe to park?

No good "quickly looking at the sign" in London, or you'll get a lot more PCNs ! You were 48 minutes too early to park there.

There may, however, be a "technical" challenge available, so hopefully the expert on these will soon be along. Technical appeals are for when the council, (or TfL also), do not follow the process and the regulations that they MUST do in order to legally enforce PCNs. At the moment, the PCN looks OK to me.

I was wondering the same thing, I reckon I saw other cars parked and possibly with oncoming traffic I made a rushed decision.  I just think its ridiculous considering the amount of shops that are there on that road.

@Aubama for now call TFL and ask for the video, in the meantime I might have had an idea but I'd like to see the CCTV first.
I practice law in the Traffic Penalty Tribunal, London Tribunals, the First-tier tribunal for Scotland, and the Traffic Penalty Tribunal for Northern Ireland, but I am not a solicitor or a barrister. Notwithstanding this, I voluntarily apply the cab rank rule. I am a member of the Society of Professional McKenzie Friends, my membership number is FM193 and I abide by the SPMF service standards.

@Aubama it's impossible to see if there's any signage left, are you able to go back and check and get photos? Ideally it would be good to have a short video, maybe we can make something out of the sign's visibility. There's also the fact that if you submit some video evidence with your representation, TFL are unlikely to provide a copy to the tribunal and then we can get them for failing to provide a true copy of the representations.

In any case all TFL PCNs are subject to various technical challenges, but bear in mind the deadline is 8 December so you don't have loads of time.
