Oxfordshire Council - 3 months late?

Hi chaps

Received this NTO issued 4/11 yet apparently contravention happened on 2/8/24?
We have no idea who was driving at the time so long ago.

Can this appealed due to being out of time or is there any other challenge that can be applied?

We cannot tell because we know so little.

As regards being 'out of time', it's not because under the regs the authority have 6 months to serve a NTO and this merely 3.

Was an initial challenge made? If not, why not?
Photos of car in alleged contravention?
Background to the issue?
Who was driving is immaterial, this process is 'owner' liability.

Yes car in our name
No challenge made initially as its the first we have known about this.
So whoever was driving may have received a PCN but not told us.
Photos show the car parked outside a parking bay.

Maybe quicker just to pay the reduced rate :(

That is long gone. You are in for the full penalty of £50.

It's worth having a look at the photos on line to check a mistake hasn't been made, and you might as well make representations as they're not currently offering the discount, but may well do so in their inevitable rejection. This may also contain errors that can get it dismissed at tribunal. Others may spot errors in the NTO that render it void.

The 'royal' we or is the registered keeper a company?

If we had the VRM and PCN number we could at least look at their photographic evidence.

is the car hired or leased ? Who holds the V5C Registration Certificate for the vehicle ?

OP, has given me details which have enabled me to view their photos. They prefer not to make these, their details, public which is their choice but does hinder peer review.

Photos show car parked 3/4 on DYL with the remainder (rear) just inside a bay*.

IMO, the CEO was being generous in using the lower level penalty for 'not parked wholly...' when many would have gone for the more obvious 'parked in restricted street...' there being clear DYL under most of the car.

The traffic sign simply states 'Pay at Machine' and this is situated within the parking place. Unfortunately, the CEO's photo of the machine is not in focus and doesn't show charging hours, so it's not possible to know whether the car was parked during restricted hours. There appears to be an envelope on the windscreen, but not of the yellow and black variety.

OP, you need to make reps and reassess after you receive their response. As suggested by others, this in itself could drag victory from the jaws of defeat.

OP, as you've not made reps prior to now, you could do so based on the obvious if you were not the driver e.g. no indication as to whether the contravention occurred during the bays's operational time because this info is not carried by the traffic sign and the CEO's photo of the machine is out of focus and does not disclose the operational hours of the bay. If it occurred outside the restricted hours then the location should be considered an unrestricted length of street and therefore the contravention could not occur.

*- bay is not internally divided, so not being parked wholly etc. refers to the end of the parking place as opposed to an internal sub-division.

Appeal made based on advice above.

PCN cancelled. Not too sure why but thanks all !


I can advise that the PCN was issued because the vehicle was parked not wholly within a bay however it has come to light that this PCN was issued in error. This error invalidates the notice and I confirm that the notice has been cancelled.
Please disregard the PCN that was issued to you. No further action is required on your part.
Please accept my apologies for this error and any inconvenience this matter may have caused.
