My memory might be playing tricks, but I recall a Bristol case where a £9 cheque was sent ro pay the toll and they cancelled.
Yes we have seen a case like that. That being said if they miss the 56 day deadline, they don't really have a choice and they have to cancel whether they like it or not. I somehow doubt they'd bother going to the small claims court to recover the £9 toll.
