Author Topic: Brent Council – Code 53J – Failing to comply with a restriction  (Read 38 times)

Hi, I would really appreciate some advice.

I usually drop off my son at Sudbury Primary School and have used this road on school days for over two years. The restriction in question is at the junction of Perrin Road and Dyson Court. There is a long give-way line, and the restriction is to the left beyond that point.

Normally, I park near the give-way line and walk my son to school. On the day in question, the spaces where I would usually park were occupied, so I turned right and reverse-parked into a bay on the other side of the give-way line.

At the time, I believed this was permitted because I had not turned left into the restricted section of the road. I have now received a PCN with photographs of my vehicle and a video showing me reversing into the parking bay.

The video does not appear to show how I approached the bay. It only shows the reversing manoeuvre, with the restriction sign ending up behind or underneath my vehicle. During the manoeuvre, I did not see the sign and did not believe I was entering a restricted area.

I have attached:

* A dashcam image showing my view as I approached the junction.
* A dashcam image showing the location where I parked, opposite the give-way line.
* The PCN and images provided by the council.

Based on these circumstances, do I have any grounds to challenge the PCN, or am I likely to be liable for the contravention? Any advice would be greatly appreciated.

Thank you.

There are "known knowns" which we may never have wished to know. This applies to them. But in the field the idea that there are also "unknown unknowns" doesn't apply as they hide in the aleatoric lottery. I know this is true and need to be prepared knowing the "unknown unknowns" may well apply.
