Blue Badge Not Clearly Displayed

The 2-year-old child passenger I was with at the time of the incident has a blue badge. I took them to the park and picked up some conkers, which they wanted to take home. There's a little section in my car where I place the blue badge if needed. I keep two pairs of sunglasses there also. I just chucked the conkers on there as it was the easiest thing to do at the time. Driving back I remembered I was supposed to pick up some milk, so parked in a blue badge space next to the shop and put the correct time on the blue badge time thingy. Because of the conkers the blue badge was partly concealed, but I'm pretty certain I made sure that you could read the vital information if looking from the right angle - he will doubtless have taken a picture from a dodgy angle, but I'm not sure how to get hold of it. Anyone know how to ask Bolton Council for this? I was in the shop not five minutes, and when I came out there was a parking ticket, so this is looking like the most expensive milk I've ever bought. It reads: conravention code 40 "parked in a disabled persons parking place without clearly displaying a valid person badge". This was 29th Sept. It says if I pay within 14 days I get a reduction from £70 to £35. Part of me thinks I should just pay (not that I have a spare £35 kicking about) and part of me thinks that that parking attendant was looking for any excuse to write a ticket. Any thoughts anyone?

"Without clearly displaying" is subjective.  You say the BB and clock was visible, so somebody is wrong. Why not take photos of how the BB and clock was placed, and compare it with any photos the CEO may have taken.

Please also post-up the PCN, all sides, so we can check it for fatal errors. YOu'd be surprised how may we find.

You could have a look on https://bolton.zatappeal.com/ as most councils nowadays let you access the photos through their website.

Hi, tried that but despite putting in the correct PCN number their website just tells me that it's "Not a valid ticket".

Well, I've been occasionally re-trying to enter the PCN number throughout the day with no luck, and they haven't replied to my email. Should I attempt to ring them?

Okay, I now have a picture. It would seem I'm a little more a fault than recalled. As i got out the car I threw the little one's hat onto the dash, and it also appears to be covering some of the badge (I thought it wasn't from where I was sat, silly me). Still, the attendant could have made out that I was within the time frame and also that badge is valid. Should I throw myself at their mercy and try to ask for leniency or just pay?

I think it is fair to say that the BB was not clearly displayed..... and even the most sympathetic of adjudicators would struggle should it come to that.

Barring any technical issues with the PCN I would be thinking on an apologetic plea for discretion, in a rush with a nadgy two year old with special needs, clean forgot to check the BB was clearly displayed..... here is a copy of the BB.... ensure you confirm that the little one was with you.

Many councils have a one strike policy with BB holders and this sort of error and will cancel the first time so worth asking in the discount period.... they should re-issue the discount even if they say no.

I'm happy to do as you suggest. I figured out what i have been doing wrong online (I've been entering "B" "0" (as in the number zero) but it should be "B" "O" as in BO[LOTON]. However, when i try to go further it now tells me "Unfortunately you are unable to appeal this charge at this time" - even though it is not yet two weeks. Any advice?

You are on day 12 so don't lose time trying to fix web link.
Email addy on back of PCN....use that.
Ensure you include PCN number and your name and address

Big thank you to you all, as the council have agreed to waiver the PCN. Here is there response...

"Thank you for your correspondence regarding the above mentioned Penalty Charge Notice.
The Council allows individuals one cancelled penalty charge notice when they have incorrectly displayed a disabled badge. On
future occasions, please ensure that the disabled badge is displayed with the front facing forward showing the expiry date from
the outside of the vehicle.
As you have produced a copy of your badge with your challenge I am able to waive the penalty charge notice on this occasion.
Please ensure that the disabled badge is displayed correctly, as subsequent notices may not be cancelled."

That'll do nicely..well done.

Now please learn from this...no conkers, hats or sunglasses. LOL
For what it is worth, I now have one of those wallets that hold the BB and timeclock...keeps them together and makes it easier to open and put on dash
