Author Topic: Birmingham, code 34 being in a bus lane, Broad Street (Berkley St Outbound)  (Read 1062 times)

I wondered if I could get some advice on this PCN the keeper has received from Birmingham City Council please.

The alleged incident involved the driver (not me) driving down (outbound) Broad Street in Birmingham, and accidentally driving into the bus lane/bus gate. This did happen, but the driver realised immediately they had missed the (correct, allowed) road on the left (Berkely Street), and turned the car around immediately - unfortunately this involved passing over the bus lane entry by a couple of meters. Before then proceeding correctly down Berkely Street.

The video evidence I believe shows this clearly - car travels past Berkely Street, starts to turn left but slightly too late to make the turn, and so pulls in immediately and turns the car around.

Do you think there's a case to get this cancelled?

Car is leased.

You say it's leased - the lease company is usually the keeper. From the dates it looks like company has made reps naming you as hirer.

That's good because you can make reps.

I expect you had to pay an admin fee to the lease firm.

I thought I was the keeper, and the lease company are the owner? But yes it's leased - I haven't received anything from the lease company directly - Luckily they don't tend to charge me for forwarding tickets (I've had parking invoices previously) :)

Yes.Having viewed the video, it is clear you did not drive down the street on seeing the signs, but turned the car round in the safest way possible, but you had to pass the signs by a few feet at the most. I would therefore submit reps on the basis of "the contravention did not occur - de minimis". It is a trivial contravention, and the PCN is the typical money-grubbing demand for money we see so often. All sense of proportion and decency has completely gone from councils nowadays, who behave like Nazi gauleiters. This is an example.
