PCN for parking on Electric vehicle recharging point

Hi

I received a ticket for parking on an electric vehicle charging point. On some, it says 'electric vehicle charging point only,' but on the one I have parked, it doesn't. I have appealed this ticket, but Hackney rejected it

NATURE OF CONTRAVENTION: 14 - Parked in an electric vehicles' charging place during restricted hours without charging

Thank you for writing to us.
We have carefully considered what you have stated, but we have decided not to cancel your Penalty Charge Notice.
You were issued a Penalty Charge Notice for parking in a bay for Zone T permit holders with electric vehicles to charge their batteries. There is a sign there explaining this. Even if you have an electric vehicle, you can only park there if you are charging your battery.
We must advise you that a condition of use of such bays is that the electric vehicle is on charge. The observation/grace period of 3 minutes that the Civil Enforcement Officer (CEO) is instructed to give for this bay is to allow residents/motorists to access permits and other mitigating circumstances to be determined.
In this instance, the Civil Enforcement Officer started observing at 10:30 and issued a Penalty Charge Notice to the vehicle at 10:33, which indicates that they were in the vicinity of the vehicle for at least 3 minutes. We believe that 3 minutes is sufficient time for the Civil Enforcement Officer to witness mitigating circumstances in progress.

We have noted your comments and the circumstances that you have described; however, you were not permitted to park in this bay without a charge taking place and meeting the parking requirements. Please be advised that as a motorist, it remains your responsibility to always check the relevant sign(s) and road markings for any space, in which you intend to park. The motorist must ensure that they have parked in line with the parking rules and restrictions.
Please note that the place where the contravention took place has been checked and the signs and road markings are correct, and compliant with the Traffic Signs Regulations and General Directions (TSRGD) 2016 and The Traffic Management Act 2004.

We have a statutory obligation to ensure all road signage is compliant. If you require additional information regarding the parking restrictions within the London Borough of Hackney, please visit our website at  https://hackney.gov.uk/parkingrestrictions.

We are satisfied that the contravention has occurred. Therefore, the Penalty Charge Notice remains enforced; however, we have extended the discount period for a further 14 days, allowing you to pay at the discounted rate, which will be accepted as full and final payment for this Penalty Charge Notice.
The enclosed photos help to show why your Penalty Charge Notice was issued.

in fact, the website they talked about is wrongly spelled the real one is https://hackney.gov.uk/parking-restrictions, and there is no mention of electric charging bays

We need to delve into the order but this appears to be a EV bay restricted to zone T permit holders during zone T hours - I can see why it's confusing.
