Author Topic: Barnet YellowBox PCN - 31j entering and stopping in a box junction when prohibited  (Read 120 times)

Hi all,

I recently got a PCN through the post for stopping at a yellow box junction.

My situation is as follows. I was driving on the main road with ample space to pass the yellow box junction. However from my left hand side there's a side road where they can join the main road but they are only allowed to turn left, ie follow the flow of the traffic.

In this case what happened was that the vehicle coming out of the left hand side decided to exit the side road (disregarding me) and turned right. As he did so he had to wait for oncoming traffic to clear from his left hand side. This put me in the unfortunate position of stopping on the box junction to allow him to pass through. I'd like advice on if I can appeal the PCN as in my view I can and what would be the best wording to use in such a case.

Video shows no contravention. You were already in the box with a clear exit beyond the box, when the van just drove out in front of you despite there being a give-way line in his direction. I suggest you have a look at the video yourself.

This is a typical automatically-generated PCN that London councils are now sending out. The footage is supposed to be viewed before a PCN is served, but such are the humungous sums of money being generated by PCNs. (well over £600 million a year), they just send them out knowing most people cough-up straightaway. A nice little earner for them.

I agree but I wasn't sure if it constituted as me stopping, it was literally a second or two. In this case I guess I just appeal and say the car was never stationary. Is there a time limit of some sorts that the council should keep in mind before judging that the car stopped at the box?

No contravention - forget about stopping. Your receiving space was clear. I can't see this losing at the tribunal should Barnet not cancel.

As a further point, the van is never completely stationary so you can't be in contravention in any case. Only stopping due to a stationary vehicle constitutes a box junction offence.

Yes van didn't stop and as I suspected the driver disobeyed turn left signs...

A good point to add into an appeal, the driver of the van driving illegally. All of this is obvious from the video, thus showing a total money-grubbing PCN served solely to get the money in.
