TEC has said that the PCN has been registered on 30th July.

I have checked with my tenant and the OfR has been sent to the previous address!
Looking at the letter, it may have been posted on 4th August. There were other usual How to pay pages and TE9 form attached too.

IMO,
You have to submit TE9 and TE7 because of the council's incompetence.

But you have to prove this, so:

TE9 - did not receive PCN

TE7 - At the date of the contravention (PCN *****) my registered address was ****. On 22 May 2026 during the enforcement process I instructed the council to use a different address because I had moved. This was acknowledged by the council's action in sending a letter dated 12 June to the new address. I therefore had no doubt that when the OfR was issued I would receive this in a timely fashion.

I did not.

The council addressed the OfR to my old address and this did not come to my attention until after 20 August, this being the latest date for submission of an in-time Statutory Declaration.

I therefore request that my declaration be accepted out-of-time.

Enclosed are:
My instruction regarding change of correspondence address dated 22 May;
Council's letter to new address dated 12 June
Copy of the OfR which I obtained yesterday. (..note I put yesterday because this would seem consistent with your account)

My thoughts

Good morning.

I have recieved a letter from the county court today instructing LBBD to cancel the charge certificate.

It is bewildering that a letter takes 10 days to arrive! Wasn't 2nd class a 2-3 days service?

To be clear, which grounds did you select on the TE9?

The ball is now in the council's, as opposed to the county, court!

Your timetable is incredible.

You filed your WS on 1 Sept and they responded on the same day but posted on 3rd.

Unheard of.

But it's history.

The council must serve a further NTO if they want to proceed. I suspect they won't, because addressing the previous one to your old address was a procedural impropriety of enormous proportions.

But time will tell.

While you're waiting, what does their website say? As I understand it, the council is notified electronically and therefore has had ample time in which to reduce the PCN amount to the full penalty.
