As at today, the LBBD website shows the penalty as £210 i.e. a Charge Certificate has been issued but not an Order for Recovery.

IMO, notify the authority NOW that with immediate effect your address for correspondence regarding PCN ****** is **** and not ******. Include a copy of your new V5C if you have this, otherwise DVLA's confirmation and proof that you are the person whose name is held by DVLA e.g. driving licence(with your new address, I hope) etc.

Good morning tincombe.

I notified the council after you advised me to do so and they sent me letters about the PCN to my correct current address.
I checked with TEC on the week of 3rd August and the PCN was still not registered.I have been on holiday last week.
I have checkd on the council's website today and the fine seems to have increased to £221. I will call and double-check with TEC today if the PCN has been registered ( which I think it now has been )

I called TEC and they said the PCN was registered with them on 30th July.
I am pretty sure I called them on the 3rd of August and they said it still had not been registered.

Anyway, they said I have to fill in a TE9 form which no longer needs a solicitor's stamp and send it back.

Do you have this in writing?

they sent me letters about the PCN to my correct current address

Pl post these and your notice to them to change your address for correspondence.

IMO, you are NOT under any obligation to submit a TE9 until you receive this from the authority. However, they are under a duty to serve this on you without delay after obtaining TEC's approval because TEC's clock starts when they approve the authority's request. So, if the authority serve your TE9 late then this limits the time you have to respond and could lose it completely.

The system is open-ended i.e. TEC assumes the authority will serve the TE9 in a timely fashion and will reject any submission by you which, according to TEC, is out of time on the assumption that the authority acted properly. The authority does NOT send TEC a copy of what they send you(which would enable them to reset their clock), they just move on as if everything is fine leaving owners high and dry if a TE9 is not served as required.

Hence my questions above about written confirmation from TEC and the authority's 'letters'.

TEC only confirmed by phone. I do not have this in wrinting.

Notice to LA to change address:

Letter in post to correct address from LA :

TEC sent me an email on the 18th when I was on the phone and sked me to fill in the TE9 form.

HMCTS – Traffic Enforcement Centre: HMCTS Civil Contact: To make an out of time Witness Statement application a TE9 & TE7 (attached) must both be fully completed correctly and submitted together for each penalty charge number.

TE9 :

TE7 :

The completed TE9 & TE7 forms could be submitted as below:

Email
tec@justice.gov.uk

The out of time process can take up to 14 weeks before an out come is known. When we know the outcome you would be notified of it in writing.

? Who introduced 'out of time', it's not relevant.

IMO, you should be proactive because twice during this thread your assumptions have proved to be wrong i.e. that you'd updated your DVLA details when you changed your address for insurance purposes and 'I called TEC and they said the PCN was registered with them on 30th July.
I am pretty sure I called them on the 3rd of August and they said it still had not been registered.'.

IMO, call the council.

Have they registered the debt, when was OfR sent and to which address?

I have never rcvd an OFR. The charge certificate was sent to the old address on 6th May/.

We know.

And then you notified the council of your change of address for correspondence, but have we seen this?

And then you said that they sent documents relating to the PCN to your new address. Fine, they're using your correct address.

..or are they??

Now it appears that an OfR has been issued but not received.

1. The idiots sent it to your old address - I do hope so and this is one of the reasons you put your notification of change of address in writing;

2. The OfR was addressed correctly and has simply been delayed/gone astray.

Is there any way you can check with your old address regarding 1? Otherwise, as suggested, you should contact the council and find out when and to what address the OfR has been sent.

Over to you.

I think a bit of a recap is required at this point :

7 Feb - Traffic warden issues fine
20 Feb - Informal challenge submitted
4 March - Informal challenge rejected
I keep waiting for letters in post and nothing arrive.
Then, I check my V5 and see that my address is that of my other property from which I moved to my current property this year but  thought I had updated it!
Unknown date - NTO sent to other address, this has been binned by tenant
6 May - Charge certificate sent to other address, this was retained by tenant
12 May - Updated address with DVLA. New V5 rcvd shortly after
22 May - Informed LA to update address
12 June - General letter / payment reminder from LA to correct address
30 July - PCN is registered with TEC
18 Aug - I phone TEC and they inform me when PCN was registered with them and email me TE9 form

"notified the council of your change of address for correspondence"

"they sent documents relating to the PCN to your new address"

I will ask my tenants at my old address if the OfR has turned up.

Should I send the TE9 form to TEC before I get my hands on the OfR?
As far as I remember, there was a 10 day or 21 day rule.
You must first check with TEC whether the PCN debt has been registered. Once it has you can submit your TE9. If the PCN is not registered they will just reject your TE9.
