Dear team,

I have received a PCN from Newham Council. I would be grateful for your opinion before taking action.

VRN: LP21UTT
Date of Contravention: 12/06/2026 at 07:12:40
Location: Barking Rd E16/Morgan St E16
Contravention: 34j Being in a bus lane (camera enforcement)


The driver does not agree with this charge because it was the end of the bus lane, he can drop off the passenger as a PCO licensed driver. Do you think it can be challenged based on this ground?

Dear Sirs,

I am writing to make formal representations against the above Penalty Charge Notice. I respectfully request that the PCN be cancelled on the grounds that I am a licensed Private Hire Vehicle driver and that the vehicle entered/crossed the bus lane solely to safely access the kerbside to drop off a passenger.

At the time of the alleged contravention, I was carrying out a pre-booked private hire journey. The manoeuvre was not an attempt to drive along or use the bus lane to gain an advantage over traffic. It was a brief, necessary crossing of the bus lane to reach the kerbside for passenger drop-off, after which I left it straight away.

Transport for London’s published guidance for taxi and private hire drivers recognises that Private Hire Vehicles may cross bus lanes to gain access to the kerbside to pick up or drop off passengers, provided the vehicle leaves the bus lane immediately. I complied with that guidance: my entry into the bus lane was limited, direct, and solely to serve the passenger safely at the kerb. I also took care not to stop at a prohibited bus stop clearway or in a way that posed a danger or obstruction to other road users. The vehicle was neither waiting in the bus lane nor being driven along it as a route. The action was a brief and reasonable manoeuvre directly connected to my licensed duties as a PHV driver.

In support of this appeal, I can provide evidence of my PHV driver licence, PHV vehicle licence, booking record, and any relevant trip details showing that the passenger drop-off was taking place at the material time.

For these reasons, I respectfully ask the authority to review the circumstances and cancel the Penalty Charge Notice. Following review of the CCTV footage, it clearly evidenced dropping off a passenger and leaving straight away, and it was the end of the bus lane.
