Barking and Dagenham PCN, code 62 now at Notice to Owner stage

Good evening everyone,

Earlier this morning (09/10/2025) at 06:57am I received a PCN for contravention code 62
‘Parked with one or more wheels on or over a footpath or any part of a road other than the carriageway’.

My vehicle was parked on the road outside of controlled hours(usually 8:30-5:30). The car was close to the kerb but did not touch the lowered kerb or raised edge.

Any advice for the appeal would be greatly appreciated thank you.

The PCN was almost certainly issued for parking outside bay makings on the footway.

We need to look at signage about footway parking and also whether such parking is allowed by resolution.

What is the Google Maps location.

I have just checked the Google maps view and it has not been updated since March 2022 when this road was not a controlled parking zone.

I will take some pictures of the signage in the morning and upload the images.

So these are footway parking bays.

The yellow line should not be there by a parking place - it's a conflict.

Were you aware you were parked outside bay markings?

Do you have a resident permit?

Council may have a resolution disapplying the footway ban here as there is historical footway parking there.

I don’t have a residents permit but I live at the residence I was parked outside of, I have a driveway and was only parked there temporarily in the morning as I needed to load up the boot before work so just did a rough parking.
This was at 06:57 so thought it was fine to park there as it was outside of controlled hours.

OP, the sign you posted isn't germane to the issue.

Have you actually checked? Go down the road on your side as far as you can if necessary pl.

CPZ and parking on the footway are not mutually exclusive.

The other car in the photo is neatly parked within white lines. Coincidence?

We need as much info as possible about this locality. Time for legwork from you* pl. And we need wide angle photos so that we can see the environment. For example, the permit parking sign could be anywhere. And by the way, it's c**p if the council think this conveys permission to park on the footway, especially when there's a yellow line which prohibits such places.The council don't have a clue.

*- on which point, are you the registered keeper with current DVLA details?

This is a factor in how you manage the issue, therefore what's their policy regarding PCNs.

As regards the signs and SYL, they're c**p.

The hours of the SYL are the same as these so-called res parking bays on the footway. Impossible. The legal issue is that the SYL prohibit parking on the carriageway AND FOOTWAY during the CPZ hours, therefore they cannot co-exist. Furthermore, as the res parking signs are NOT of the form which permits parking on the footway then by virtue of these signs the council is ENTICING motorists to break the law. It has a LEGAL DUTY to enforce the law, in this case a statute, and is derelict in this responsibility if it does not i.e. they must penalise everyone who parks wholly within, partly within or not within these markings. So, why single you out?

They're a bloody shambles.

But they're also judges in their own cause and you could submit reps supported by the most eminent jurists of the last century and they'd still say no!

The next stage would be a Notice to Owner served on the registered keeper who might be the company or it might be a leasing company, but it certainly isn't you, I'm afraid.

Thanks for your response.

Do I have any grounds for appeal in this case.

In this case the contravention code given was 62 however my wheels weren’t touching the lowered kerb, am I able to use this for my appeal.

Nothing to do with dropped kerbs...which is a contravention ONLY if you're parked in whole or part on the carriageway adjacent to a lowered/raised footway.

Pl forget all about lowered kerbs.

IMO, the whole set up is conflicting and  But given that these have only recently been put in place, IMO you would stand no chance at this stage, hence why I asked about who is the registered keeper, the company's approach to PCNs etc. which IMO should be aired before reps are considered.

What's possibly interesting is that the council's traffic order creates parking places as though they were on the carriageway - there is nothing showing 2- or 4-up parking, just standard parking bays.
But they've plonked them on the footway inside a yellow line.

From what I understand, the parking bays aren’t actually for parking due to the single yellow line.

Could I have any grounds based on this being outside of the 8:30-5:30 time frame?
