Barking and Dagenham, 52M failing to comply prohibition of veh

Hi,

Today we received a charge certificate for the above.

We did not receive the original PCN. Never had an issue with post at this address, no issues with v5c.

I don't know much about these matters other than I am not paying extra money when I was not in receipt of the PCN.


What are my next steps in these circumstances?

For clarity, I am not looking to challenge the PCN. Just not pay extra

See process for getting this reset. You make a statutory declaration when the council sends you an order for recovery with the debt registered at the Traffic Enforcement Centre.

Where a Enforcement Authority believes that a moving traffic contravention has occurred, it may serve a Penalty Charge Notice on the person appearing to them to be the owner of the vehicle. This is...

The above is the cast-iron way of getting back to the original PCN. Some councils have been shown in recent times to have not sent out postal PCNs, so this may be the problem, although it is rare.
There is no harm done if contact the council to tell them you never received the original PCN, but be very careful as if they to promise to cancel the CC and send out the PCN again, you need it in writing/print. Never, ever, trust council verbal promises.

Thanks guys.

I did phone yesterday and having read the above link what she said now makes sense.

She said to wait for it to go to the next stage and there's a tick box as they can't do anything about it in customer services now. ::)

Yes, it would and when you get back to the PCN stage the discount should be available again.

That confirms it was never delivered because the Missus would have just paid it without telling me  ;D
