PCN Issued - "And Opposite"
« on: »
Hello

Morning. I am not sure, but i saw this yellow restriction / warning board yesterday evening and saw the door numbers and thought it doesn't affect me where I have parked. This morning around 6.30 AM a PCN was issued. And after receiving the PCN, I went around around the warning board and then reading it few times, realised it said "and opposite". Not sure why they would say "opposite" instead of door numbers ?

Can someone tell me If I can challenge this ? Is it ok to even say "and opposite" in the yellow restriction warning boards ? Here are the images, please check and let me know.

Can only see images of suspension sign; one side of redacted PCN; and close-up of Traffic Order.
The last, incidentally, appears to prohibit access and says nothing op parking restrictions???

So, please post both sides of the unredacted PCN and the GSV link, together with any council photos.

IMO, It is not a 'suspension' sign in the accepted sense i.e. suspending the use of a parking place in exercise of powers under a Traffic Management Order, it's a 'traffic sign' purportedly giving effect to 'The London Borough of Newham blah blah Temporary Prohibition of Traffic Order 2026.

IMO, contravention did not occur because the use of the parking place was not suspended, all the Order does is 'restrict traffic access along.., it does not suspend statutory parking controls.

'7)An order or notice made or issued under this section [14] may—

(a)suspend any statutory provision to which this subsection applies'

An Act to consolidate the Road Traffic Regulation Act 1967 and certain related enactments, with amendments to give effect to recommendations of the Law Commission and the Scottish Law Commission.
