AF30428290 PCN
« on: »
Hello

Have received a PCN and was recommended to obtain free advice here.
Please see details below, grateful for any help:

1.
Council: Redbridge
Alleged contravention: Entering and stopping in a box junction when prohibited (camera enforcement) on 20/01/2025
Location: Cameron Road, Ilford

2.
I've viewed the video on the councils website. I was only in the box junction for 10 seconds and that was only because after I judged it to be okay to move forward (as cars in front began to move), pedestrians started to cross suddenly. You'll notice that I'm quite close to the car in front of me as I had to stop suddenly and unexpectedly. It feels quite unfair to be penalised for that. Also with the box junction being so close to the pedestrian crossing, it's bound to happen.
Is there any possibility to appeal this and win? Or is it unlikely?

It is also worth adding that they have sent the PCN to my parents house where I no longer live. My address has been updated and is reflected on my driving license as well.

3.
PCN is attached.

OK, you updated your driving licence, but did you update the address on the V5 Registration Certificate you hold for the vehicle ? We see people on here with bailiffs at their door who know nothing about a PCN, because they have not updated their V5.  Postal PCNs are sent to the name and address on the V5.

I looked at the video just, and it does not show the vehicle entering the box therefore is not valid as evidence, and being the sole evidence, means the contravention is not made out.

Confirmed - OP, if you persevere with this one you will triumph as the council evidence is insufficient to prove you committed an offence.

"...a person* must not cause a vehicle to enter the box junction so that the vehicle has to stop within the box junction due to the presence of stationary vehicles."

*I wonder who they'll blame if it's a robotic vehicle.

Hello all,

Many thanks for your replies.
I did not think of the V5, silly me. I'll go ahead and update, thanks for informing!

As for the alleged offence, thank you for explaining. I will go back now and challenge.

Keep you posted.

Best Wishes,

Please put a draft of your representations on here before issuing so we can check you've raised the correct arguments.

Hi all,

Just an update.

Firstly, apologies for jumping the gun - I went ahead and challenged but next time will share my draft before submitting.
Secondly, glad to inform you that the council has waived the PCN as a "gesture of goodwill". Lol whatever that means.

Thanks a ton all!
