Merton Council - Hertfield Road - Appeal Advice

New to the forum but just had a response on my appeal I thought anyone going through a fine with the notorious Bus Lane on Hertfield Road would like to know.

"This PCN was issued for the alleged contravention of being in a bus lane. Approval from the
Secretary of State for the type of prescribed device used for this bus lane enforcement is a
requirement under paragraph 7(2) of Schedule 1 to the London Local Authorities Act 1996 (the 1996
Act) in order for the camera evidence to be admissible in these appeal proceedings. On the evidence
before me, there is no valid approval of the device for the purposes of the 1996 Act. It follows that
there is no admissible evidence of the appellant's vehicle being in a bus lane and the appeal is
allowed."

The cameras used are not approved by SoS - if you've received a fine, appeal it and get to work. I've just won my appeal as a result of this.

There are "known knowns" which we may never have wished to know. This applies to them. But in the field the idea that there are also "unknown unknowns" doesn't apply as they hide in the aleatoric lottery. I know this is true and need to be prepared knowing the "unknown unknowns" may well apply.
