Hi

I got a PCN for my parking in Ealing. I had parked for 8 hours (I park here every single day for work), and paid as normal, however I was leaving work later than normal so I used the app to extend.

However, as I was closer to a different car park the app defaulted to that one and I ended up paying for parking in a different car park. Worth adding, extending would've been OK as there is no time limit to parking - so I wasn't trying to avoid that.

I contested it with proof on the app showing original parking, and parking paid for in the next car park (both Ealing council), and they've refused and said I need to pay £55 (discounted rate) regardless.

Whilst I appreciate I made a mistake, its a very honest mistake - is there any point contesting further? £55 seems grossly unfair when I did pay for £10 parking originally and then another £2 in the wrong car park!

The below is in the confirmation they have declined my challenge:

"Although you may have had a valid PayByPhone session for another location, this does not
invalidate the PCN. PayByPhone confirms the location and vehicle’s registration before
payment is made. It is your responsibility to ensure that payment is made to the correct location
number stated on the PayByPhone sign on display at the location where your vehicle is parked."

Any advice appreciated on next steps.

Post the PCN and your challenge and their full rejection.

You say you used the app to 'extend' - this would imply extending an existing session. Did you actually start a new session?

Yes, where I should've extended I created a new one by mistake. This will be as the app defaulted to me being closer to the other car park I think and I didnt double check. I get it was wrong, but it is an honest mistake, and I cant see how a £55 fine is justifiable when I did pay for the other car park I wasnt in!

My challenge I sent is the below:

: Hello I park here all the time, 3 days a week. I always pay, on this occassion I needed to extend my parking payment as I was in the office later than expected. However, when I went to do this, it looks like it created a new parking session at a different car park by mistake - probably because I was closer to that one than this. I have attached proof of this, I have my parking until 1640 and then a new one I made by mistake instead of extending at 1644. I think this is an honest mistake and I did pay for my parking, just in the carpark next door rather than this one! Please help. David

Surely one can only extend a session whilst that session is running. You said your first session ended at 16.40, and you tried to extend at 16.44. This must have been why the app started a new session.

I don’t have the original paper ticket anymore but the website says the below if this helps:

Again I don’t dispute what happened just dispute the fine and fairness when I paid for a different Ealing car park next to it!

Yes, but have you read my comment about extending a session. As I understand it, one can only extend a session whilst that session is still within its end time. So there was no session to extend when you tried to extend your session.
