From what you said you needed to submit a Witness Statement by 1 or 2 September.
Whilst it may be that the case will be struck out, you may now be in the position of having to submit a WS in a hurry. Not for good reasons.
You either submit a WS now anyway, or you hope that it all goes away. If you want to play it safe, submit a WS now.
