PROCEDURAL ISSUE?

I may have found an issue with the Traffic Management Order, would appreciate others' thoughts:

I was reflecting that it is an odd place for a single yellow as no clear reason for it.

(Schedule 1 a) iii) details relevant ‘Mon-Fri, Midday – 1pm’ waiting times restriction).

ETO purportedly made under s9 Road Traffic Regulation Act 1984. s9(3) RTRA provides 'no ETO shall continue in force for longer than 18 months'.

ETO entered into force 1 May 2024 (see link above, page 1). 18 months elapsed on 1 November 2025? Purported PCN issued 10 February 2026.

Am I correct to believe this should be a slam-dunk?

I’m aware a new/permanent TMO may have been made, but cannot find any more recent on Hillingdon’s website or elsewhere. I've made an FOI request for any and all TMOs affecting relevant road and will update.

Are you the registered keeper with current DVLA records?

I ask because the next stage in enforcement is for the RK to be served with a Notice to Owner allowing them to make formal reps. The response to your enquiry should be front and centre IMO.

Never, ever, underestimate the effect of anecdote and received wisdom in local government i.e. the signs are there, therefore the road must be restricted, mustn't it!! (2 restrictions in fact)

Thanks tincombe. Yes I'm the RK and up to date with DVLA.

Waiting for NtO just trying to get ducks in a row. Have made a further (broader) FOI to double check no other parking restrictions can be claimed later on...

Can't say I fancy my chances at formal reps stage. But seems silly not to give it a go.

Result: PCN cancelled.

Just closing this topic - council confirmed by post yesterday that PCN has been cancelled in response to formal reps.

Posting those formal reps and council's response below in case it is of any interest in similar cases where there is doubt about Traffic Management Orders.
