PCN on Lyon Road, Harrow - assumed Free Parking

Dear Free Traffic Legal Advice Team,

I’m reaching out for guidance, as I’ve searched this forum for information on “free parking in Harrow” but haven’t been able to locate anything relevant. It’s possible I may not be using all the search functions correctly, so apologies in advance if I’ve missed something.

On 10 July, my wife parked on Lyon Road while shopping in Harrow. She understood that Harrow operates a one‑hour free parking policy.

Harrow Council’s published parking policy states that many controlled parking areas offer a “first hour free” concession to support short‑stay visits. However, the Council’s website also explains that drivers must actively start a parking session in order to claim this free hour. The signage at Lyon Road does not mention any free hour, nor does it indicate that a parking session must be activated to gain the free hour.

Any chances of getting this cancelled?

I had already drafted a letter, but thought I should check with experts like yourselves beforehand.

Subject: Informal Challenge – PCN XXXXXXXX, Lyon Road, Harrow

I wish to submit an informal challenge against PCN XXXXXXX, issued on Lyon Road, Harrow.

My wife parked for under one hour and believed she was parked legally. The signage at Lyon Road does not provide clear or adequate information regarding the parking conditions. Specifically:

The sign lists only paid tariffs.

It does not state that a one‑hour free parking concession exists.

It does not instruct drivers to activate a PayByPhone session to claim any free period.

It does not warn that failure to activate a session would result in a PCN.

This omission makes it impossible for a driver to understand that any action is required. The signage therefore does not meet the council’s obligation to provide clear, unambiguous, and enforceable instructions under the Traffic Signs Regulations and General Directions (TSRGD).

Harrow Council’s own published parking policy explains that many controlled parking locations offer a “first hour free” concession, intended to support short‑stay visits. The policy also states that drivers must start a parking session to claim the free hour. However, the signage at Lyon Road does not mention any free hour, nor does it communicate the requirement to activate a session. This contradicts the council’s published policy and creates a legitimate expectation that the first hour is free unless signage clearly states otherwise.

Importantly, Harrow Council has not published any notice withdrawing the one‑hour free parking concession on Lyon Road. There is no Traffic Management Order (TMO) amendment or public consultation indicating that the free hour has been removed at this location. The free hour remains part of the council’s parking policy, yet the signage at Lyon Road does not mention it or instruct drivers to activate it. This inconsistency makes the parking conditions unclear and unenforceable.

Please see attached photographs of the signage at Lyon Road. The images show that the sign displays only paid tariffs and contains no wording about a free hour, session activation, or any penalty for failing to activate a session. The absence of this information prevents compliance and renders enforcement unreasonable.

Given:

the unclear and incomplete signage,

the contradiction with the council’s own published policy,

the lack of any formal withdrawal of the free hour at this location,

the legitimate expectation created by Harrow’s “first hour free” scheme,

the documented pattern of confusion among motorists, and

the fact that the stay was under one hour and caused no loss to the council,

I respectfully request that the PCN be cancelled.

So why did you not follow the instructions on the sign, which seems very clear ? THere is no mention of any free hour, so you should have assumed this location did not offer this concession. You also say that their website also refers to "many controlled parking areas offer a “first hour free” concession". Many, implies not all.
Anyway, best if we can also read what you have read, so can you please post a link to this published policy on a free hour, please. 

Submit your reps by all means but I don't think you'll succeed in getting the PCN cancelled.

Please find below a copy/paste from Harrow Council website on the Free parking:

One-hour free parking
You can park for free for up to one hour once per day in on-street parking bays and most car parks managed by the Council.

To get free parking, you must have an active parking session with PayByPhone, or through the nearest PayPoint location shown on the signs or the Pay & Display machine where PayPoint is not available.

The free one-hour parking is only for your first visit to any paid parking bay per day. Free parking is not available in resident permit holder bays unless stated on signs.

Please check signs carefully for payment options when parking. All parking sessions, including free ones, must be registered to avoid a Penalty Charge Notice.

Dear Free Traffic Legal Advice Team,

I wanted to provide an update following my previous thread and seek further guidance.

After the last discussion, we submitted a written representation and posted the letter on 21 July — well within the 14‑day reduced‑payment period — using Royal Mail Track & Sign. Harrow Council signed for the letter on 23 July.

We received no communication from them until 12 August, when a Notice to Owner (dated 10 August) arrived. On the same day, we emailed Harrow to advise that our representation had already been submitted and signed for, and requested cancellation of both the PCN and the Notice to Owner.

We have now received a letter dated 20 August (received on 21 August) titled “Notice of Rejection of Representation”, demanding payment of £110. My understanding was that if a representation submitted within the discount period is rejected, the council should re‑offer the discounted amount of £55. Could you please confirm whether that is correct?

Additionally, I would appreciate the team’s view on whether the issuing of an NTO despite having already received my representation has any procedural implications for the validity of the PCN.

I can upload the rejection notice if the team would like to review it.

There is no legal mandate for the discount to be offered when a council rejects informal reps, but most councils do so, Havering being the exception.
However, if Harrow have not re-offered the discount it is now a complete no-brainer to register an appeal at London Tribunals and get an unbiased judgment. It is a no-brainer, because the penalty remains the same and there are no additional costs at all. If you lose, you pay the £110, and if you win you pay nothing.

Thank you again for your post.

Just revisiting the PCN and on the back of it states : "If we receive reps within the 14-day reduced-payment period, but do not accept the challenge, we will allow a further 14 days from the date the rejection letter is served in which to pay the reduced penalty charge".

I am assuming that I should be availed the reduced payment since I had already submitted our rep within the 14-day reduced-payment period.

I also think that Harrow council have inadvertently sent out the NTO and then on the back of that - provided the Notice of Rejection.

I would appreciate your and the FTLA team thoughts on this and any further direction that can be provided.

The PCN commits the council to:

Respond in writing to any reps made within the initial 14-day period; and
To re-offer the reduced sum for a period of 14 days from the date the rejection letter is served.

Obviously the NTO cannot be such a response because it demands the full penalty.

 
And the NOR fails to advise you of 'the form and manner in which an appeal to the adjudicator may be made'. So, add Procedural impropriety to the list of grounds.

So you have:
1. Contravention did not occur;
2. Penalty exceeded to amount applicable in the circumstances of the case; and
3. Procedural impropriety 1;
4. PI 2 possibly.

Not a bad hand!

1. I haven't looked at your arguments in detail, but they were made in the initial reps so I suspect you'll stay with them.

2. First step is that YOU have to prove that reps were made within the 14-day period. But as you've got RM tracked and signed-for mail this shouldn't be a problem. But pl post this proof. Then the burden shifts to the council to prove they responded consistent with their obligation.

3. PI. The NOR is grossly defective e.g. 28 days from NOR being served (FFS, after 18 years you'd think they'd get this right), it does not advise you of the adjudicator's power to register a late appeal(which it would be if you submitted on day 28 of their calendar!!) etc.

4. Let's see what was submitted after you received the NTO pl.

1) Do we use the Notice of Appeal to make the rep that you have suggested? or
2) Do we send Harrow council an email making the rep?
3) Is there any particular wording that I have to use to make the rep compelling?

FYR - The rep that we made in the letter we sent to LBH is as below :

Dear Sir / Madam,

RE: Informal Challenge – PCN xxxxxxx, Date 10/07/2026

I wish to challenge PCN xxxxxxx issued on Lyon Road.
The signage at this location does not communicate a mandatory condition of parking. Harrow Council’s published parking guidance states that all parking sessions — including free ones — must be registered to avoid a Penalty Charge Notice.
However, the sign at Lyon Road:
•   lists only paid tariffs,
•   instructs drivers to “Pay by phone” only in the context of paid parking,
•   does not state that activation is required when no payment is due,
•   does not state that a £0.00 session must be registered, and
•   does not warn that failure to activate a session will result in a PCN.
A motorist cannot be expected to infer that “Pay by phone” applies even when the tariff is £0.00, nor that failure to activate a free session constitutes a contravention. This is a mandatory condition that the council has chosen not to sign.
My wife parked for under one hour. The requirement to activate a session — even when no payment was due — was not communicated on the sign, preventing compliance.
This issue is not isolated. Multiple motorists have reported similar confusion on consumer and legal forums such as MoneySavingExpert and FTLA, where Harrow’s signage is repeatedly described as unclear and incomplete. Several motorists have successfully appealed PCNs because Harrow failed to sign the activation requirement.
Given:
•   the absence of any instruction to activate a session when no payment is due,
•   the failure to sign a mandatory condition of parking,
•   the council’s own published requirement to register all sessions,
•   the documented pattern of confusion among motorists, and
•   the fact that the stay was under one hour,
I request that the PCN be cancelled on the grounds that the contravention did not occur due to inadequate signage.
